Participating terms and conditions:

1. APPLICATION FOR SPACE:

All applications for participation as an Exhibitor shall be made on the prescribed Space Reservation Form. The form shall be submitted to NurnbergMesse India Pvt. Ltd. (hereinafter referred to as Organiser).The Organiser has the sole right to determine the eligibility of any prospective participant (Exhibitor) to take part in the exhibition.

2. ALLOCATION OF SPACE:

The Organiser has the sole right to allot appropriate space (by way of the stall or open space) to an Exhibitor. The Organiser further reserves the right to reallocate the Exhibitor to any other space or stall(s) than that was first allocated. Please note, for structural reasons pillars and supports are fundamentally included in the calculated stand area without entitlement to reduction. The stand rent is paid merely for the rented area, i.e. other installations or extensions are not included in this rent. The decision of the Organiser with regard to the allocation of space shall be final and binding on the Exhibitor.

3. CANCELLATION OF CONTRACT AND WITHDRAWAL BY EXHIBIT

  • Cancellation of booked space on or before 19th August 2021 – 100% Refund of payments received & credited into our account until the date of cancellation.
  • Cancellation of booked space between 20th August 2021 and 28th November 2021 – 25% of the invoice value will have to be paid to NurnbergMesse India Pvt. Ltd. mandatorily.
  • Cancellation of booked space on or between 29th November 2021 and 31st December 2021 – 50% of the invoice value will have to be paid to NurnbergMesse India Pvt. Ltd. mandatorily.
  • Reduction of originally booked space on or between 29th November 2021 and 31st December 2021 –exhibitor will be invoiced for 50% of the released/reduced space cost in addition to the space cost for the eventual space booked after reduction.
  • Cancellation or reduction of booked space on or after 31st December 2021 –100% of the invoice value will have to be paid to NurnbergMesse India Pvt. Ltd. mandatorily.
  • No show after confirming space via SRF - 100% of the invoice value will have to be paid to NurnbergMesse India Pvt. Ltd. mandatorily.

4. Payments

The organizers hereby would like to inform the exhibitor/ partners that NMIND does not authorize any person, any company to collect payment on their behalf. All payments have to be made to “NMIND”

While the organizers have taken necessary steps and precautions, however, in the light of increasing cyber frauds and threats, exhibitors must re-reconfirm the accounts details via a telephone call to NMIND or NürnbergMesse India Pvt. Ltd. before making the NEFT or wire Transfer. The organizers would not be responsible for any loss due to cyber fraud. Booth possession would be subject to clearance of all the dues.

5. POWER CHARGES-RAW SPACE:

In a Bare Space booth, only the marked area is provided. You will NOT be provided with any furniture, carpet and electrical fittings or booth panels / fascia name board. Temporary Power connection of 1 KW and Permanent Power connection of 5 KW will be mandatory for raw space at an additional cost of Rs.3000/- per KW +18% GST (subject to change). You will need to design your booth as per your theme / brand you intend to project with help of your advertising agency or stall designers. Raw Space booths are usually taken by companies who intend to have designer booths to project their theme / brand.

6. SHELL TO BARE:

Only marked area will be provided for Shell Scheme Exhibitors converting to Bare Space booth. You will NOT be provided with any furniture, carpet and electrical fittings or booth panels / fascia name board. Temporary Power connection of 1 KW and Permanent Power connection of 2.5 KW will be mandatory for bare space at an additional cost of INR 3000 / per KW (Subject to Change) +18% GST (subject to change). You will need to design your booth as per your theme / brand you intend to project with help of your advertising agency or stall designers. Raw Space booths are usually taken by companies who intend to have designer booths to project their theme / brand.

7. POWER CHARGES-SHELL SCHEME:

Additional Power requirement will be charged as above for Shell Scheme Exhibitors apart from the regular power outlet of 5/15 amp per 9 m2 which will be provided.

8. SECURITY DEPOSIT BY DD OR CASH ONLY:

Refundable Security deposit by DD in favour of NurnbergMesse India Pvt. Ltd. or Cash is to be paid by the Raw Space Exhibitor’s Stand Contractor along with the design submitted as per the slab mentioned below. The Security Deposit by DD/Cash will be returned provided the stand contractor completes booth building / dismantling as per guidelines & rules and regulations.

  • INR 25,000/- per stand up to 50 m2
  • INR 50,000/- per stand for 51 - 100 m2
  • INR 1,00,000/- per stand for 101 - 200 m2
  • INR 2,00,000/- per stand above 201 m2

9. FAILURE TO OCCUPY SPACE:

Should an Exhibitor fail to occupy allotted space by the date and time specified for installation of exhibits, the Organiser would be at liberty to take over such space and reallocate and / or use the same as the Organiser deems fit. No refund will be given for last minute cancellation.

10. HANDLING AND CARE OF EXHIBITS:

The Organiser shall bear no responsibility for damage to the Exhibitor's property or lost shipments nor moving costs. Failure of exhibits to arrive in time for the exhibition is not a cause for cancellation of space contracted and the Exhibitor will be liable to pay the space cost in full.

11. THE EXHIBITOR MANUAL WILL CONTAIN THE DETAILED TERMS & CONDITIONS APPLICABLE FOR:

  • Decoration & Display
  • Stand dismantling
  • Exhibitor & Booth representatives

12. DAMAGE TO PROPERTY:

The Exhibitor is liable for any damage caused to the building, floor, walls, panels, carpeting and / or to standard items and fittings provided within the booths. The Exhibitor may not apply paint, adhesive or any such material, which would damage the fittings, fixtures and furniture provided by the Organiser. Rights to further claims for damages shall be reserved.

13. EXHIBITOR'S PROMOTIONAL ACTIVITIES:

All sales or sales promotion activities by the Exhibitor including the handing out of literature, brochures, samples, handouts, etc. must be confined to the designated booth of the Exhibitor. The Organiser directly prohibits any such promotional activities to be carried out by the Exhibitor in the passages, aisles etc. that may tend to obstruct attendees from visiting other booths, exhibits, etc.

14. NOISE & SMELL:

The Exhibitor will not be permitted to display anything, which causes offensive levels of noise, smell or other effects of pollution.

15. SAFETY:

The safety of Exhibitors, attendees as well as that of exhibits is of paramount importance. Consequently the Exhibitor must scrupulously comply with all relevant fire and other safety regulations. All electrical wiring and electrical fittings must conform to or be better than appropriate standards and no improper joints, lack of fuses, switches and other unsafe devices will be permitted. No inflammable, poisonous, explosives (including gas cylinders) or radioactive material shall be used without the approval in writing of the relevant authorities as well as the Organiser. To ensure clear access to safety and fire exits, no obstructions or display materials will be allowed in any of the aisles or passages.

16. SECURITY:

The general security of the show / exhibition grounds is arranged by the Organiser without liability for losses or damage. The Exhibitors themselves are responsible for the supervision and guarding of their stand. This also applies during the stand construction and dismantling periods, before the start and after the close of the event. For the security of the stand during night hours the Organiser recommend commissioning, at the Exhibitor's expense, a standing guard from the security company responsible for the event / exhibition. An order of this nature for special guards should be discussed as early as possible with the Organiser. The Exhibitor and their staff may not remain in the stand overnight.

17. INSURANCE:

The Exhibitor is strongly advised to ensure adequate insurance covers including extraterritorial coverage for property damage, public liability, theft, fire, etc.

18. RIGHTS OF ADMISSION:

The Organiser may at their discretion, frame or amend the rules regarding Rights of Admission to the exhibition taking into account the best interests of the Exhibitor and attendees as also existing rules and regulations in this matter of the landlord of the venue of the exhibition.

19. TERMINATION / POSTPONEMENT OF EXHIBITION:

The Organiser reserves to themselves the absolute right without assigning any reason, force majeure or otherwise, to cancel or postpone the exhibition (or part thereof) or its commencement of continuance and appropriately may terminate this contract. If the Organiser terminates this contract and / or the exhibition (or part thereof), then the Organiser has the right to retain such part of amounts received from the Exhibitor as shall be adequate to compensate the Organiser for expenses incurred until the time of termination of the contract.

20. FORCE MAJEURE:

The Organiser shall not be liable for delay or failure of performance with respect to cancellation or postponement of the show caused by an act of God, action by any governmental or quasi - governmental entity, fire, flood, insurrection, riot, explosion, embargo, strikes whether legal or illegal, transportation interruption of any kind, or any condition beyond the control of organisers ("Force Majeure Events"). In such events, the Organiser shall be entitled to retain such portion of the contract price as required to compensate the expenses incurred up to the time of the force majeure event.

21. INFRASTRUCTURE FAILURE:

The Organiser shall not be responsible for any air conditioning or electricity failure, theft, any act of law or requirements of public authority or other causes.

22. AMENDMENT OF RULES:

Any matter(s) not specifically covered herein shall be subject solely to the decision of the Organiser, who shall also have full power in the matter interpretation, amendment and enforcement of all said rules and regulations. Further any such amendments when made and brought to the notice of the Exhibitor shall be and become part of these rules and regulations hereof as though duly incorporated and subject to all the conditions stipulated.

23. NON OBSERVANCE / DEFAULT:

In the event of non-observance of or default on any of the terms herein, including without limitation any rules or regulations framed pursuant to this contract, the Organiser the shall have the right to terminate this contract without notice and retain all amounts received on the account as liquidated damages. On such termination, the Exhibitor must close his booth and remove himself and his exhibits from the exhibition.

24. NO VERBAL AGREEMENT:

No verbal agreement between Organiser and Exhibitor is tenable unless the same is confirmed in writing.

25. LIMITATION OF LIABILITY:

The Exhibitor hereby agrees to indemnify and hold harmless the Organiser, endorsees, sponsors, venue landlord and their officers, employees and representatives against all action, claims, proceedings, expenses, damages and costs whatsoever resulting from its participation in the exhibition and occupation of space contracted for by reason of personal injuries, death, property damages, etc. Exhibitor further agrees to indemnify the Organiser against and hold them harmless for any claims and for all damages, costs and expenses including all legal fees and settlements incurred in connection with such claims arising out of the acts or the negligence of the Exhibitor, his officers, employees or representatives.

26. JURISDICTION:

Place of fulfilment and jurisdiction is Bengaluru, India. However, NMIND reserves the right to bring its claims before the court of the place at which the EXHIBITOR has his place of business.

27. AGREEMENT TO THESE RULES:

The Exhibitor for himself or themselves, his employees, agents and representatives agree to fully abide by the foregoing rules and by any amendments that may be put into effect by the Organiser.
